Swiss Trustee
Switzerland is one of the world’s leading financial centres. Known for its neutrality, economic and political stability, and highly skilled workforce, the country has high ethical standards, clear and fair laws, and an excellent reputation. In addition, Switzerland is home to many reputable banks and financial service providers with strong local and international networks. These factors and more set the country apart.
History
Switzerland does not have national trust legislation. However, the country ratified the Hague Convention on July 1, 2007, and thereby acknowledged any foreign law trust that falls within the Convention’s definition of trusts. Swiss lawmakers then introduced new provisions related to trusts in the Swiss Private International Law Act and the Federal Debt Enforcement and Bankruptcy Act. Subsequently, the Swiss federal tax administration enacted a tax circular, which addresses definitions of trusts and related parties of trusts and their tax positions in Switzerland. By ratifying the Convention and adding these provisions, both trustees and settlors now have more clarity and certainty – and foreign settlors may establish trusts under any foreign law that provides for trusts with Swiss trustees.
Trustee operating in Switzerland
The Swiss trust industry’s reputation for integrity and accountability got another boost when the Swiss Financial Institutions Act (FinIA) became law on January 1, 2020. Now, trustees operating in Switzerland must be licensed by the Swiss Financial Market Supervisory Authority (FINMA).
In 2021, DNM Swiss AG was one of the first Swiss trustees licensed by FINMA.
